Definitions

PLATFORM: the FeelGoodFellows website accessible at https://www.feelgoodfellows.com and all associated services.
PUBLISHER: FEELGOODFELLOWS SAS, a simplified joint-stock company (société par actions simplifiée) with a share capital of €1,000, registered with the Bordeaux Trade and Companies Register under number 909 783 490, with its registered office at 15 Sente des Caboteurs, 33300 Bordeaux, France. USER: any individual who creates an account on the Platform, whether acting in a personal capacity or on behalf of an Organisation.
ORGANISATION: any company, association, educational institution, or entity that uses the Platform to create and manage competitions for its members.

Purpose

These Terms of Use define the conditions of access to and use of the Platform.

Creating an account implies full and unconditional acceptance of these Terms. The PUBLISHER reserves the right to modify the Terms at any time. USERS will be notified of any changes. Continued use of the Platform after modification constitutes acceptance of the updated Terms.

Registration and account

USERS may freely create an account on the Platform. They may also be invited to join a competition by another user or by an ORGANISATION.

Each USER has personal login credentials (email and password). The USER is responsible for keeping them confidential. Any use of the account is deemed to have been made by the USER.

In the event of fraudulent use or compromise of their account, the USER must notify the PUBLISHER immediately at contact@feelgoodfellows.com.

Minimum age and minors

Access to the service is reserved for persons aged at least 13. When creating an account, the USER declares that they are at least 13 years old; failing this, the account is refused and deleted.

For minors aged 13 to 15 (or up to the age of digital consent applicable in their country of residence), the ORGANISATION that registers them for a competition warrants that it has obtained the prior parental consent required to process the data of the minors concerned, in accordance with applicable regulations (in particular the GDPR).

Intellectual property

The content of the Platform (text, graphics, software, images, videos, trademarks) is the exclusive property of the PUBLISHER or its partners and is protected by intellectual property law.

No reproduction, even partial, may be made without the explicit authorisation of the PUBLISHER. The USER is granted a personal, non-exclusive right to use the Platform, limited to the scope of the services provided.

User contributions

USERS may publish content on the Platform (photos, videos, text) as part of competitions and quests. By publishing content, the USER represents and warrants that:

they hold the necessary rights to the published content;
the content does not infringe on the rights of third parties (intellectual property, image rights, privacy);
the content complies with applicable laws and these Terms.

FeelGoodFellows enforces a zero-tolerance policy toward objectionable content and abusive behaviour. Contributions and behaviour must not under any circumstances:

be contrary to public order or morality;
be defamatory, discriminatory, hateful, violent, pornographic, or incite hatred;
harm the honour or reputation of others;
constitute harassment, intimidation, threats, or insulting remarks directed at another user;
involve impersonation or any other form of abusive or malicious behaviour toward the community;
reproduce content protected by intellectual property rights without the rights holder's authorisation.

The USER is solely responsible for the content they publish. Any USER publishing objectionable content or engaging in abusive behaviour is subject to the removal of their content and the closure of their account, without notice. The PUBLISHER shall not be held liable for content published by USERS.

Hyperlinks

The Platform may contain links to third-party websites. The PUBLISHER has no control over these sites and accepts no responsibility for their content.

Publisher's liability

The PUBLISHER endeavours to ensure access to the Platform 24/7, subject to maintenance operations and force majeure events.

The PUBLISHER does not guarantee the permanent availability of the Platform or the absence of errors. Information available on the Platform is provided as is. The PUBLISHER shall not be held liable for any damage resulting from the use or inability to use the Platform.

Content moderation

The PUBLISHER acts as a hosting provider under applicable law. Contributions are not reviewed prior to publication.

Each USER has, within the application, tools allowing them to report objectionable content or behaviour and to block another user. Any problematic content may also be reported at: contact@feelgoodfellows.com

The PUBLISHER undertakes to review any report and, where the objectionable nature is manifest, to remove the content concerned and eject (ban) its author within 24 hours of the report.

The PUBLISHER reserves the right to remove any contribution that violates laws, regulations, or these Terms, and to suspend or close the account of the USER concerned.

Cookies

The Platform uses technical cookies necessary for its operation (authentication, session) and audience measurement cookies. USERS may configure their preferences via the consent banner displayed on their first visit.

Personal data

The collection and processing of personal data are described in our Privacy Policy. In accordance with the GDPR, USERS have rights of access, rectification, erasure, portability, and objection. In the event of a dispute, USERS may lodge a complaint with the CNIL (www.cnil.fr).

Applicable law

These Terms are governed by French law, regardless of the place of use. In the event of a dispute, and after an attempt at amicable resolution, the French courts shall have sole jurisdiction.

Image rights

By publishing photos or videos on the Platform, the USER warrants that they have obtained the explicit consent of any identifiable person appearing in such content, in accordance with image rights law.

The USER authorises the PUBLISHER to host and display published content as part of the normal operation of the Platform (display to competition participants, rankings, galleries).

Any use of content outside the Platform (press, social media, advertising, commercial materials) requires the explicit consent of the USER and any identifiable persons in the content.

If an ORGANISATION wishes to use content from its competitions outside the Platform, it must obtain the necessary authorisations directly from the USERS concerned.
